NJ Second Offense Driving While Intoxicated Penalties
Because you already faced a first DWI, you are probably aware that first offenses have a two-tier sentencing system based upon the reading. There is only one tier with regard to second and subsequent offenses. If your BAC is above .08% at the time of the breath test, and you do not qualify for the Ten-Year Step-Down Rule, then you are facing:
- fees between $500 and $1000,
- a two-year license suspension up to
- 48 hours – 90 days of jail time
- 30 days of community service
- 48 hours Intoxicated Driver Resource Center (IDRC)
- Installation of an Ignition Interlock Device
