NJ Felony Expungement Lawyer

New Jersey statute allows for the expungement of a prior felony under many circumstances. Pursuant to N.J.S.A. 2C:52-2, you can have an indictable offense (otherwise known as a felony) expunged five years (or four years under Early Pathways) after the completion of probation, release from jail, payment of fines, and conviction date. Remember, the time period commences only after the latest of the aforementioned penalties have been satisfied. Therefore, a prior conviction of an indictable offense can be expunged four or five years following the completion of penalties associated with the offense. McGuckin Law assists people in obtaining expungements of their New Jersey criminal records statewide. Can I Have Multiple NJ Offenses Expunged From My Record?

Yes you can under the right circumstances. Generally speaking, you can have one indictable and up to three disorderly persons offenses expunged. If you have more than one indictable conviction, you are likely barred under the general indictable offense expungement unless the multiple convictions are subject to the same Judgment of Conviction and were adjudicated at the same time. However, if you have more Ethan one prior crime, and multiple offenses on the same Judgment of Conviction, you are likely not eligible for a standard Indictable Offense expungement. If you have multiple indictable convictions, please consider visiting the Clean Slate Expungement page or Spree Doctrine page to gain an understanding of your eligibility in situations involving multiple felony offenses.

Can I Have My NJ Third Degree Drug Charges Expunged?

Convictions for 3rd or 4th Degree possession of narcotics with intent to distribute or distribution, depending upon the substance, weight, and other considerations, may be expungable but also may require a statement of compelling circumstances, in which you would inform the court why your expungement is in the interest of the public. Fortunately, completion of Pre-Trial Intervention (PTI) for the above offenses does not bar the expungement of a later conviction. For more information, see Expunging Indictable Drug Offenses.

Can I Have My NJ Criminal Record Expunged Early?

You may be eligible for an Early Pathway expungement. If four years have elapsed since your felony conviction, payment of fines, completion of probation, and/or incarceration and you have had no other criminal contacts since, you can apply for an Early Pathway expungement by listing compelling reasons that the expungement should be granted. If the court finds that the compelling reasons are adequate, you can be eligible one year earlier, making the wait period four years instead of five.
